Terms of sale

Article 1 — Purpose and scope

These terms of sale (the "Terms") govern all sales made on the site sportivearena.com between Sportivearena (the "Seller") and any natural person, not acting as a trader, acting for purposes outside their professional activity (the "Customer").

Every order implies unreserved acceptance of these Terms in the version in force on the day of the order. The Customer acknowledges them by ticking the box provided before validating payment.

The Seller may amend the Terms at any time. The Terms that apply are those accepted when the order was placed.

Article 3 — Products

The products offered are fitness equipment and accessories for home use. Their essential characteristics, including dimensions, materials, load and usage limits, are described on each product page in accordance with article L111-1 of the French Consumer Code.

Photographs and illustrations are indicative and not contractual; shades may vary depending on your screen.

Training programmes and advice published on the site are provided for information only and do not constitute medical advice. If you have any doubt about your fitness to exercise, consult a healthcare professional.

Article 4 — Prices

Prices are shown in euros, inclusive of all taxes, excluding delivery costs. Any delivery costs are shown before the order is validated and repeated in the summary.

The Seller may change prices at any time. The price that applies is the one displayed when the order is validated.

Struck-through prices correspond to prices actually charged previously by the Seller, in accordance with the rules on price reduction announcements.

Article 5 — Discount codes and loyalty programme

Discount codes are valid on the conditions and for the period stated when they are issued. Unless stated otherwise, only one code may be used per order and codes cannot be combined.

Loyalty programme benefits are personal, non-transferable and cannot be converted into cash. The Seller may change the programme, with no retroactive effect on benefits already earned.

Article 6 — Orders

The sale is concluded through the "double click" process set out in article 1127-2 of the French Civil Code: after selecting items, the Customer checks the order details and total price, corrects any errors, then confirms the order and pays.

Confirmation constitutes acceptance of these Terms and formation of the contract. A confirmation email summarising the order is sent to the Customer without delay.

The Seller may refuse or cancel any order that appears abnormal, in particular in the event of a previous dispute, suspected fraud, or quantities plainly intended for resale. The Customer is informed and refunded in full.

Orders are archived by the Seller and may be provided to the Customer on request.

Article 7 — Availability

Offers are valid for as long as they are visible on the site and while stock lasts at our partner warehouses.

If an item is found to be unavailable after the order, the Customer is informed as soon as possible and refunded in full within 14 days of payment at the latest.

Article 8 — Payment

Payment is made in full on the day of the order, by bank card (Visa, Mastercard, American Express, Cartes Bancaires), Apple Pay, Google Pay or any other method offered at checkout.

Transactions are encrypted and secured by the SSL protocol and 3-D Secure strong authentication. At no point does the Seller have access to the Customer's bank details, which are handled directly by the payment provider.

The order is processed only once payment has actually cleared.

Article 9 — Delivery

Areas served, times, costs and tracking arrangements are set out in our shipping policy, which forms an integral part of these Terms.

In accordance with article L216-4 of the French Consumer Code, the risk of loss or damage passes to the Customer when they take physical possession of the goods.

If the maximum announced time is exceeded, the Customer has the rights set out in article L216-6 of the same code, recalled in the shipping policy.

Article 10 — Right of withdrawal

The Customer has 14 days from receipt of their order to exercise their right of withdrawal without reason or penalty, in accordance with articles L221-18 and following of the French Consumer Code. This right applies to all items, including those on promotion.

The Seller voluntarily extends this period to 30 days, as a commercial commitment adding to the Customer's legal rights.

How to exercise it, return costs, the model withdrawal form and the legal exceptions appear in our return and refund policy, which forms an integral part of these Terms.

Article 11 — Legal guarantees

All products benefit as of right, independently of any commercial guarantee, from:

  • the legal guarantee of conformity (articles L217-3 and following of the French Consumer Code): the Customer has 2 years from delivery of the goods to act, does not have to prove the defect exists during that period, and may choose between repair and replacement of the goods, at no cost;
  • the guarantee against hidden defects (articles 1641 and following of the French Civil Code): the Customer may act within 2 years of discovering the defect and choose between rescission of the sale and a price reduction.

The Seller offers no additional commercial guarantee, and would rather say so plainly than promise otherwise.

Article 12 — Customer service and complaints

For any question or complaint, the Customer may write to info.contact@sportivearena.com or call +33 7 75 77 61 28, 7 days a week from 8am to 8pm. A reply is given within 24 hours.

Article 13 — Consumer mediation

In accordance with article L612-1 of the French Consumer Code, the Customer has the right to use a consumer mediator free of charge to settle a dispute amicably, having first tried to resolve it directly with the Seller through a written complaint.

The mediator must be contacted within one year at most of your written complaint to the Seller. Mediation is free, optional, and does not deprive you of any judicial remedy.

Article 14 — Liability

The Seller is liable as of right for the proper performance of the contract, in accordance with article L221-15 of the French Consumer Code. The Seller may be released from that liability on proof that non-performance is attributable to the Customer, to the unforeseeable and insurmountable act of a third party unconnected with the contract, or to force majeure.

The Seller is not liable for damage resulting from use of the product contrary to its purpose, to the instructions supplied or to the usage limits stated on the product page.

Article 15 — Force majeure

Neither party may be held liable for a failure to perform its obligations resulting from force majeure within the meaning of article 1218 of the French Civil Code. If the impediment is permanent, the contract is terminated and the Customer refunded in full.

Article 16 — Personal data

Personal data collected is processed in accordance with our privacy policy and our legal notice, in compliance with the General Data Protection Regulation.

Article 17 — Intellectual property

All elements of the site are protected by the French Intellectual Property Code. Any unauthorised reproduction or exploitation is prohibited and constitutes infringement.

Article 18 — Partial invalidity

If any provision of these Terms were declared void or unenforceable, the remaining provisions would keep their full force and effect.

Article 19 — Governing law and disputes

These Terms and the contracts arising from them are governed by French law.

In the event of a dispute, the Customer may bring proceedings, at their choice, before one of the courts having territorial jurisdiction under the French Code of Civil Procedure, or before the court of the place where they lived when the contract was concluded or the damaging event occurred, in accordance with article R631-3 of the French Consumer Code.

Nothing in these Terms may deprive the Customer of the mandatory protective provisions of their country of residence within the European Union.

Article 20 — Effective date

These terms of sale came into force on 9 August 2026.
